This website, www.barebodie.com, and all related content, features, products and services (the "Services") are operated by Anubhuti Culture India ("Barebodie", "we", "us", "our"), a business based in India with its office at 492 Lane Number 2, Niti Khand I, Indirapuram, 206, Ghaziabad, Uttar Pradesh 201014. Barebodie is powered by Shopify, which enables us to provide the Services to you.

By visiting our website, creating an account or placing an order, you agree to these Terms of Service, together with our Privacy Policy, Shipping Policy and Return & Exchange Policy. If you do not agree, please do not use the Services.

1. Eligibility

You must be at least 18 years old, or use the Services under the supervision of a parent or guardian, and be legally able to enter into a binding contract under Indian law.

2. Products and Information

  • We try to display our products, colours, sizes and descriptions accurately. Colours may look slightly different because of screen settings and lighting.
  • Fit can vary by style and fabric. Please use our size guide before ordering. Size guidance is a guide, not a guarantee of fit.
  • We may change, discontinue or limit the availability of any product at any time.

3. Pricing and Payment

  • All prices are in Indian Rupees (INR) and include applicable GST unless stated otherwise. Shipping fees and Cash on Delivery (COD) fees, if any, are shown at checkout before you pay.
  • We may correct pricing or listing errors, and cancel orders affected by them. If you have already paid, we will refund the full amount.
  • Payments are processed by third-party payment gateways. We do not store your card number, CVV, UPI PIN or net-banking credentials.
  • For COD orders, we may verify your order by phone, SMS or WhatsApp, and may cancel it if we cannot confirm it.

4. Orders

Placing an order is an offer to buy. We accept your order only when we dispatch it. We may refuse or cancel an order for reasons such as stock unavailability, suspected fraud, incorrect pricing, or an undeliverable address. If we cancel a prepaid order, you will receive a full refund.

You may cancel an order before it is dispatched by contacting us at info@barebodie.com. Once an order has shipped, it can only be returned under our Return & Exchange Policy.

5. Shipping, Returns and Exchanges

Shipping is governed by our Shipping Policy. Returns, exchanges and refunds are governed by our Return & Exchange Policy. Please note that, for hygiene reasons, underwear and panties cannot be returned or exchanged unless they are defective or the wrong item was supplied. Other intimate wear can be exchanged only if it is unworn and unwashed, with all tags, the hygiene liner and original packaging intact, as set out in that policy.

6. Discounts and Promotions

  • Discount codes and offers are valid for the period stated, cannot be combined unless stated, and have no cash value.
  • We may withdraw or change offers at any time, and may cancel orders where a code was misused or abused.

7. Your Account

If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Please give us accurate information and tell us immediately if you suspect unauthorised use. We may suspend or close accounts that breach these terms.

8. Marketing Communications

By opting in, you agree to receive offers, new launches and promotions from us by email, SMS or WhatsApp. You can opt out at any time by using the unsubscribe link, replying STOP, or contacting us. Opting out will not stop essential messages about your orders, such as confirmations, shipping updates and delivery notifications. See our Privacy Policy for how we handle your information.

9. Acceptable Use

You agree not to:

  • Use the Services for any unlawful or fraudulent purpose.
  • Attempt to hack, disrupt, scrape or overload the website or its security.
  • Place orders for resale without our written permission.
  • Abuse the returns process, for example by wearing items and returning them, or returning items that are not ours.
  • Post offensive, abusive or infringing content in reviews or messages.

We may decline a return or exchange, or limit future returns, where we find a pattern of misuse. This does not affect any rights you have under applicable consumer protection law.

10. Reviews and Content You Submit

If you submit reviews, photos or feedback, you confirm that you own them or have the right to share them. You give Barebodie a non-exclusive, royalty-free right to use, display and reproduce them on our website and in our marketing. We will not publish your images or personal details without your consent, and we may remove any content at our discretion.

11. Intellectual Property

All content on the Services, including the Barebodie name, logo, designs, photographs, text, graphics and product designs, belongs to Anubhuti Culture India or its licensors and is protected by Indian intellectual property laws. You may not copy, reproduce, modify or use it for commercial purposes without our written permission.

12. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use and protect your personal information. If there is a conflict between these Terms of Service and the Privacy Policy about your personal information, the Privacy Policy controls.

13. Third-Party Services and Links

We use third-party services such as Shopify, payment gateways and courier partners. The Services may also link to third-party websites. We do not control and are not responsible for the content, privacy or security practices of those third parties.

14. Disclaimer

The Services and products are provided on an "as is" and "as available" basis. To the extent permitted by law, we do not guarantee that the website will always be uninterrupted or error-free. Nothing in these terms limits any rights you have under the Consumer Protection Act, 2019 or any other law that cannot be excluded.

15. Limitation of Liability

To the extent permitted by law, Barebodie is not liable for indirect, incidental or consequential losses arising from your use of the Services or products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

You agree to compensate Barebodie for losses and claims arising from your breach of these terms or your misuse of the Services.

17. Force Majeure

We are not liable for delays or failure to perform caused by events beyond our reasonable control, including natural disasters, strikes, courier or network disruptions, government actions or epidemics.

18. Governing Law and Disputes

These terms are governed by the laws of India. Subject to any rights you have as a consumer, the courts at Ghaziabad, Uttar Pradesh will have exclusive jurisdiction. We encourage you to contact us first so we can try to resolve any concern informally.
